Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using HaxUnit's services, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.

2. Services Description

HaxUnit provides security scanning, vulnerability assessment, and related security services ("Services") designed to help identify potential security vulnerabilities in your applications, networks, and infrastructure. Our Services may include, but are not limited to, automated security scanning, manual penetration testing, vulnerability assessment, compliance checking, and security report generation.

3. Account Registration

To access certain features of our Services, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Payment Terms

Some of our Services require payment. By subscribing to a paid plan:

  • You agree to pay all fees in accordance with the pricing and payment terms presented to you
  • You authorize us to charge your designated payment method for all fees incurred
  • All payments are non-refundable except as expressly stated in these Terms or as required by law
  • For subscription services, your subscription will automatically renew unless you cancel before the renewal date
  • We may change our fees and payment terms at any time, with notice provided at least 30 days before changes take effect

5. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use our Services to scan or test systems you do not own or have explicit permission to test
  • Attempt to bypass, disable, or otherwise interfere with security-related features of our Services
  • Use our Services to harm, threaten, or harass any person or to impersonate any person
  • Use our Services to transmit any malware, spyware, or other harmful code
  • Use our Services to engage in any activity that could damage, disable, or impair our servers or networks
  • Attempt to gain unauthorized access to our Services, user accounts, or computer systems
  • Use our Services to infringe any intellectual property rights or violate any laws

6. Intellectual Property Rights

Our Services and all content, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by HaxUnit, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for your internal business purposes, subject to these Terms.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall HaxUnit, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use our Services
  • Any conduct or content of any third party on our Services
  • Any content obtained from our Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claim arising from or relating to these Terms or our Services, regardless of the form of the action, is limited to the amount paid by you to HaxUnit for the Services during the 12 months prior to the claim.

8. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that our Services are free of viruses or other harmful components.

While our Services are designed to identify security vulnerabilities, we do not guarantee that all vulnerabilities will be identified or that our Services will protect against all possible security threats.

9. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes at least 30 days before they become effective. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms or our Services shall be brought exclusively in the federal or state courts located in Netherlands, and you consent to the personal jurisdiction of such courts.
